The
Department of Education, Territory of American Samoa
strongly advocates a “Zero
Tolerance Policy” on the presence
of illegal drugs on all properties of the Department
of Education.
The
“Zero Tolerance Policy”
states that:
Any
student found in possession of or have used recently,
or to have in any way encouraged the selling and use
by another student, or in collaboration with DOE personnel
of any illegal substance, i.e., marijuana, methamphetamine
(ice) etc., shall be suspended (student); until the
incident has been thoroughly investigated. If circumstances
and/or tangible evidence provided in the courts of
American Samoa indicate the defendant(s) has or have
committed an illegal act as defined in the laws of
American Samoa; the student(s) will be expelled, effective
immediately, at which time the student(s) will be
provided an alternative source of education; DOE personnel’s
employment will be terminated, effective immediately
for violation of such prohibition.
Any
personnel employed with the Department of Education
in its all divisions and sections, found in possession
of or have used recently, or to have in any way encouraged
the selling and use by another employee or student,
of any illegal substance, i.e., marijuana, methamphetamine
(ice) etc., will be promptly placed on administrative
leave (Department of Education personnel) until the
incident has been thoroughly investigated. If circumstances
and/or tangible evidence provided in the courts of
American Samoa indicates the person has committed
an illegal act as defined in the laws of American
Samoa; their employment with the Department of Education
will be terminated immediately and face prosecution
for violation of such prohibition, in accordance with
laws of American Samoa.
As
the Director of the Department of Education, I am
compelled to enforce a “Zero Tolerance Policy”
in dealing with students and personnel of the Department
of Education found in possession of; the use of; or
selling of illegal drugs on any Department of Education
premises, i.e., school campuses, motor pool, school
lunch, etc..
The
Zero Tolerance Policy
shall be enforced immediately in its compliance with
the laws of the Territory of American Samoa.
